Monique Gonzalez, Psy.D. ("us", "we", "our") is the creator and operator of this website (the "Site", drmoniquegonzalez.com), as well as the corresponding social media account (@drmopsyd), newsletter/email lists, and online offerings (i.e. courses, workshops, etc.). This page is meant to inform you of the relevant limitations and the policies associated with these online platforms. By continuing to visit the Site, you agree to the terms specified below. We consider this a living document, and may modify or update this policy from time to time based on evolving offerings, so please review it periodically. 

 

The Site is not therapy.

 

General Disclaimer Statement

 

The Site is operated by a psychologist licensed in the State of California. However, please note that the Site and its offerings are meant to provide general psychological information and wellness strategies. It is never intended to be a substitute for individualized professional treatment. Visiting and/or participating in the Site and/or in correspondence (email, social media) with Monique Gonzalez, Psy.D. in no way creates an established client-therapist relationship with Monique Gonzalez, Psy.D. and/or any other represented professional(s) on the Site or social media. The information provided is not, nor is it intended to be, psychotherapy or individualized psychological advice. If there is an agreement for therapeutic services at one point, any established therapeutic relationship would be announced, agreed upon, detailed, and covered in a separate policy document to be signed between Monique Gonzalez, Psy.D. and specific client. The Site and associated social media platforms are for educational and entertainment purposes only. Information placed on the Site, social media, or associated offerings by Monique Gonzalez, Psy.D. and her business partners may not always be complete, up-to-date, relevant, or applicable to all/your situations. Unless otherwise specified in a service agreement, when in virtual community offerings where information may be exchanged, such as, but not limited to, workshops, peer groups, and webinars, participants are made aware this also does not constitute a therapeutic client-therapist relationship. Additionally, all offerings for healing work provided via the Site, social media platform, or 'Zoom' platform, including but not limited to community/individual reflection, psychoeducation, breath work, meditation, etc. is undertaken at your own risk. 

You may not rely on the information on the Site as an alternative to medical or psychological advice from your personal doctor, counselor, or other professional healthcare providers.

If you have any specific questions about any mental health or medical matter, you should consult your doctor or other professional healthcare providers.

You should never delay seeking healthcare advice or suddenly discontinue treatment because of information on the Site or associated social media platforms.

 

Accessing Mental Health Support

 

Your safety and well-being are the priority. You may not use the Site in a manner that constitutes an infringement of our rights or that has not been expressly authorized by us. More specifically, unless explicitly authorized in these Terms of Service or by the owner of the materials, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any material from the Site or associated social media platforms. You may, however, if taking an online course/workshops/event, download and/or print associated documents/videos of the Site for your personal, non-commercial use, provided that you keep intact all copyright and other proprietary notices. On social media, you may "reshare" content only if using the appropriate "reshare" option and/or giving credit to the Site's author (Monique Gonzalez, Psy.D.)

 

Purchasing Offerings

 

Offerings are available exclusively online through the Site (powered by Kajabi) and third-party platform 'Zoom'. We reserve the right at any time to modify or discontinue a service/offering (or any part or content) without notice at any time. Prices for offerings are subject to change without notice, and we reserve the right to charge different prices to different consumers for the same offerings. This serves as a way to build in equitable structures supporting the historically marginalized and/or oppressed (i.e. BIPOC, LGBTQ+, financially stressed, etc.). All sales completed on or through the Site are final unless otherwise stated in writing. Inquiries for refunds, exchanges, etc. are addressed on a case by case basis.

 

Feedback and Testimonials

 

We are open to feedback to enhance supportive services. We reserve the right to decide when/if to implement feedback to change services. Additionally, all feedback received on the Site, connected social media platforms, and other associated online offerings becomes sole property of Monique Gonzalez, Psy.D. We shall be entitled to the use and dissemination of these suggestions, ideas, or feedback for any lawful purpose related to enhancing services, without compensation to you. There may be opportunities for you to leave reviews or testimonials if you give consent to do so, which can be used for marketing purposes on the Site and associated social media platforms. These would also become property of Monique Gonzalez, Psy.D. The testimonial experiences on the Site are personal to the particular individuals who share them, and may not be representative of all participants accessing services offered by Monique Gonzalez, Psy.D. We do not claim, and you should not assume, that all individuals will have the same experience. Your individual experience may vary. The testimonials or reviews are not intended, nor should they be construed, as claims that the services can diagnose, treat, cure, or prevent any health condition.


Using Third-Party Links


These Terms of Service apply only to the Site and associated social media platforms (@drmopsyd) and offerings by Monique Gonzalez, Psy.D., and do not apply to the sites of any other companies or organizations, including those to which the Site may link. We do not endorse or take responsibility for the contents, advertising, products or other materials made available through any other site. Under no circumstances will we be held responsible or liable, directly or indirectly, for any loss or damage that is caused or alleged to have been caused to you in connection with your use of, or reliance on, any content, goods or services available on any other site. You should direct any concerns to that site administrator or webmaster.

We are committed to protecting and respecting your privacy.  We encourage you to read this Privacy Policy carefully when using the Site or associated services, including but not limited to courses, workshops, virtual community space, or when transacting business with us. By using the Site, you are accepting the practices described in this Privacy Policy. Data protection laws vary among countries, with some providing more protection than others. Regardless of where your information is processed, we apply common protections. Rights specific to the E.U. are outlined towards the end of this document.

While using the Site, we may ask you to voluntarily provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to your name, email address, telephone number, billing address, credit card information, and other contact or identifying information ("Personal Information"). Other type of information collected may include whether a recipient clicks through the links provided in the communication and when the recipient opened the communication and clicked through links.

 

In general, we may collect your Personal Information to:

  • enroll you in a course, workshop, event;
  • deliver the services that you have requested;
  • maintain communications (i.e. email newsletter, online community collective, announce services/events from us or other third parties that may be of interest to you);
  • perform research and analysis about your use of, or interest in, our services or content;
  • enhance the Site and/or social media communications, services, and offerings;
  • enforce our terms of service;
  • use financially relevant information or payment method to process payment for any purchases made on the Site, enroll you in a discount, and other programs in which you elect to participate;
  • manage our overall business and
  • perform functions as otherwise described to you at the time of collection.

If you choose to correspond with us through email, we may retain the content of your email messages together with your email address and our responses. We do not store any credit card information we receive except as necessary to complete and satisfy our rights and obligations with regard to such transaction, billing arrangement, and/or as otherwise authorized by you.

 

With Whom We Share Information

 

As a general rule, we do not sell, rent, lease or otherwise transfer any information collected whether automatically or through your voluntary action.

There are some instances in which it would be indicated to share information or when we inform you and give you an opportunity to opt out of having your personal information shared. We may share information with third parties in the following instances:

  • Authorized providers: We may disclose your Personal Information to our service providers that support in the business functioning, such as processing payments and in collaboration with specified business partners. In the latter, you would be agreeing to this when signing up for an event (e.g. collaborative workshop).
  • Legal issues: We reserve the right to disclose your Personal Information, as required by law, when we believe that disclosure is necessary to exercise or protect our legal rights, and/or to comply with a judicial proceeding, court order, a legal obligation for cooperation with law enforcement or other government agency, or another legal process. It should also be noted that Monique Gonzalez, Psy.D., as a licensed psychologist in the state of California, is a mandated reporter, which is connected with certain legal obligations (eg. to notify law enforcement under situations of child or elder abuse). Hosting Website

 

The hosting facilities for our website are situated in the United States of America through the online business platform 'Kajabi'.

 

Accessing Other Websites

 

There may be places on the Site where you may click on a link to access other websites that do not operate under the Privacy Policy. These third-party websites may independently solicit and collect information, including personal information, from you. We recommend that you consult the privacy statements of all third-party websites you visit by clicking on the "privacy" link typically located at the bottom of the webpage you are visiting. The Privacy Policy applies only to our online activities and is valid for visitors to the Site.

 

Log Data


Like many site operators, we collect information that your browser sends whenever you visit the Site ("Log Data"). 

The Log Data may include information such as your computer's Internet Protocol ("IP") address, browser type, browser version, the pages of the Site that you visit, the time and date of your visit, the time spent on those pages and other statistics. When you provide Personal Information through the Site, the information may be sent to servers located in the United States and other countries around the world.

Credit card information is never transmitted via email. Remember that no method of transmission over the internet, or method of electronic storage, is 100% secure. Children's Privacy

 

The Site is a general audience site, and we do not knowingly collect personal information from children under the age of 13. The newsletter, blog, courses, and workshops are generally directed to adults, though there may be some offerings for adolescents. We strongly encourage parents and guardians to observe, participate in, and/or monitor and guide their online activity, as well as make use of browser parental controls where appropriate. Children should not attempt to sign up for our email newsletters. IF YOU ARE 13 YEARS OLD OR YOUNGER,  MONIQUE GONZALEZ, PSY.D. Your Choices, Your Rights

 

You can choose not to provide us with certain information, but that may result in you being unable to use certain features of the Site and associated offerings. At any time, as a consumer, you are free to terminate your subscription (newsletter, event/offering notifications) by visiting your user settings via the “Unsubscribe” link located at the bottom of any newsletter email sent by Monique Gonzalez, Psy.D. If you opt out, we may still send you transactional or relationship messages, such as emails about your account or updates.

The United States does not currently have a national privacy policy law, though best practices are used in the Privacy Policy, using the framework of California law. Note that this is separate from and in addition to the health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA). If you are within the European Union, you are entitled to certain privacy policy rights under the General Data Protection Regulation (GDPR). Not all of the details of your rights have been included in our summaries. The Privacy Policy is effective as of January 11 2021 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page. 

We reserve the right to update or change our Privacy Policy at any time and you should check the Privacy Policy periodically. Your continued use of the Site after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy. 

If we make any significant material changes to the Privacy Policy, we will notify you either through the email address you have provided us or by placing a prominent notice on our website.
